  • Received verdict in favor of architecture and engineering firm for full amount of contract amount due plus pre-judgment interest. Suit was based upon allegations of breach of contract regarding a residential development in Council Bluffs, Iowa.
  • Obtained dismissal of negligence lawsuit against a Nebraska city and its insurer on the basis that the suit was not brought in compliance with the Nebraska Political Subdivisions Tort Claims Act and Nebraska law regarding direct claims against insurers.
  • Obtained dismissal of convenience store from wrongful death litigation on the basis that the lawsuit exceeded the remedies available under Nebraska law.
  • Obtained summary judgment in favor of truck stop and its vendor who had sold lithium batteries to customer that later combusted in the customer’s pocket.
  • Successfully argued to the Nebraska Supreme Court to affirm trial court finding that a utility is not immune from alleged negligent actions that led to large fire in the Omaha Old Market district.
  • Obtained summary judgment in favor of nightclub that was sued by customer who was struck in the head with a drink glass wielded by another customer causing substantial injuries.
  • Received $1.59 million jury verdict in U.S. District Court for the Western District of Missouri based upon breach of beef supply contract.
  • Directed verdict awarded in Nebraska state court in favor of day care center defended by ES Law in personal injury action.
  • Directed verdict awarded in Nebraska state court in favor of accounting firm defended by ES Law in trade secret violation action.
